An Illinois federal judge has granted a request to temporarily pause proceedings in the Batton homebuyer commission lawsuit against the National Association of REALTORS® (NAR). The decision allows the court to wait for developments in the separate Tuccori case, where NAR recently reached a proposed settlement.
Why the Case Is on Hold
A stay is essentially a pause in the legal process. In this instance, the court determined it makes sense to delay further litigation while the Tuccori settlement moves through the approval process.
NAR argued that both lawsuits involve many of the same legal issues and claims. If the Tuccori settlement ultimately receives final court approval, it could resolve or significantly narrow the claims being pursued in Batton, making additional litigation unnecessary.

The Batton case is not over—it is simply on hold.
The length of the pause will depend on what happens in the Tuccori settlement. If that agreement receives final approval, it could provide broad legal protections for NAR, state and local REALTOR® associations, and other covered parties against similar buyer commission claims.
If the settlement is not approved or is modified through the court process, the Batton litigation could resume.
Court Rejects Additional Request
Along with granting the stay, the judge declined a separate request from the plaintiffs seeking to appoint attorneys from the Tuccori case as interim co-lead counsel in the Batton lawsuit.

The ruling highlights how closely related real estate commission lawsuits are becoming. Rather than moving multiple overlapping cases forward at the same time, courts may choose to wait for outcomes in cases that could have broader legal implications.
