Seller To Buyer After Closing: \u2018I\u2019m Not Leaving\u2019<\/p><\/div>\n

A woman in Nashville ran into an unusual problem after buying her first home: The seller is now refusing to leave.<\/p>\n

\u201cIt\u2019s been a nightmare,\u201d Tamara Holloway told News 2 in Nashville. \u201cThe seller has essentially pirated my house. Holloway closed on the home on June 1. There is nothing in the contract stating that the seller can stay past that date. But Justin McCrory, the home seller, says he\u2019s lived in the property for four years and he doesn\u2019t plan to leave.<\/p>\n

\u201cThe transaction went through and they\u2019re getting a good clean property,\u201d McCrory told reporters. \u201cWhat\u2019s the problem? … I technically don\u2019t have to go anywhere. They\u2019d have to evict me and they\u2019re not having that.\u201d<\/p>\n

Holloway filed a detainer warrant last week. That is the first step of the eviction process. Signature Title Services says the processor for the closing also has written McCrory and told him to vacate the property.<\/p>\n

So far, McCrory hasn\u2019t left.<\/p>\n

The Greater Nashville Association of REALTORS\u00ae urged buyers to make sure they get their keys at closing. Holloway did not. Also, make sure to work with the seller\u2019s REALTOR\u00ae. McCrory didn’t have one.<\/p>\n

\u201cMake sure your REALTOR\u00ae understands that it\u2019s a \u2018for sale by owner\u2019 and can work with that other party to make sure things like this don\u2019t slip through the cracks,\u201d said GNAR President Denise Creswell.<\/p>\n
