And yep, that rule is still in place for 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But\u2014and this is important\u2014<strong>offers of compensation haven&#8217;t disappeared.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A seller can still choose to offer compensation to a buyer&#8217;s broker. It just has to be communicated <strong>outside the MLS<\/strong>, such as through direct communication, emails, flyers, signs, websites or other marketing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, think of it as:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>MLS? Nope.<br \/>Negotiation? Absolutely.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83d\udcb0 Who Pays the Buyer&#8217;s Agent?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There&#8217;s no one-size-fits-all answer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Broker compensation is <strong>not set by law and is fully negotiable<\/strong>. Buyers and their agents agree on compensation in their written buyer agreement, and that agreement must spell out the amount or how compensation will be determined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A buyer&#8217;s compensation could potentially come from the buyer, a seller, a portion of the listing broker&#8217;s compensation, or another negotiated arrangement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The key word? <strong>Negotiated.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83c\udfe1 What Does This Mean for Sellers?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sellers now have more decisions to make\u2014and more conversations to have.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A seller can work with their REALTOR\u00ae to decide whether offering compensation to a buyer&#8217;s broker makes sense for their particular property and situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the seller does choose to offer compensation, the listing broker must get the seller&#8217;s authorization in writing and disclose the amount or rate before making that offer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83d\udd11 What Does This Mean for Buyers?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Buyers should know exactly what they&#8217;re agreeing to <strong>before touring homes<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your buyer agreement should explain how your REALTOR\u00ae will be compensated and what, if anything, you may be responsible for paying.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And don&#8217;t be shy about asking questions! Understanding the numbers upfront can prevent some very unpleasant surprises later.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Bottom Line<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The rules around real estate compensation may look different in 2026, but one thing hasn&#8217;t changed:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Communication is everything.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compensation is negotiable. Sellers have options. Buyers have options.
