{"id":1293,"date":"2011-11-18T13:00:18","date_gmt":"2011-11-18T13:00:18","guid":{"rendered":"http:\/\/www.anthonydidonato.net\/wordpress\/?p=1293"},"modified":"2011-11-18T13:09:58","modified_gmt":"2011-11-18T13:09:58","slug":"borough-council-legislative-meeting-votes-november-17th-2011-no-tax-hike-3rd-street-dam-status","status":"publish","type":"post","link":"https:\/\/www.anthonydidonato.net\/wordpress\/borough-council-legislative-meeting-votes-november-17th-2011-no-tax-hike-3rd-street-dam-status\/","title":{"rendered":"Borough Council Legislative Meeting Votes, November 17th, 2011: No tax hike, 3rd Street Dam Status"},"content":{"rendered":"<p><strong>Borough Council<\/strong> met on <strong>Thursday, November 17th<\/strong>, 2011 at 7:30 PM. <strong>Jim Cunningham<\/strong> was absent from the meeting.<\/p>\n<p>All votes during the meeting were unanimously in the affirmative for all legislative actions.<\/p>\n<h2>3rd Street Dam Status<\/h2>\n<p><strong>Pete Alyanakian<\/strong> gave an update regarding the 3rd Street Dam committee. He indicated that the committee met on <strong>November 3rd<\/strong> regarding design options with legal counsel. <strong>Mr. Alyanakian<\/strong> indicated that any change in the design would require approval by both parties involved in the stipulation, meaning <strong>Delaware County<\/strong>, and <strong>Broomall\u2019s Lake Country Club<\/strong>. He indicated that the 20% funding promised by the state would be discussed in a meeting in the next week with <strong>Dominic Pileggi<\/strong>, regarding the <strong>RCAP<\/strong> funding, and discussing whether the funding would also apply to any changes made.<\/p>\n<p>He indicated that on <strong>November 4th,<\/strong> a meeting of the <strong>3rd Street Dam Committee,<\/strong> <strong>Schnabel Engineering<\/strong>, and <strong>PennDOT<\/strong> confirmed that the state 80% grant will pay for 80% of whatever the borough decides to do: A breach, a green-way, or a single or multi-lane roadway. He indicated that if council chooses other options, <strong>PennDOT will pay for the alternative options.<\/strong> He clarified that the design work was put on hold in July, and that <strong>the design is 50-60% completed. <\/strong>He indicated that the design was put on hold as the borough had not decided on the width of the road.<\/p>\n<p>Lastly, he spoke regarding to the <strong>citizens advisory committee <\/strong>as requested by the <a title=\"Support Penncrest Roaring Lions Marching Band November 19th\" href=\"http:\/\/glenprovidencepark.org\/?_cr=mediapanews\">Friends of Glen Providence Park<\/a> and other residents. He stated that they have looked at various options for the committee suggested by the <strong>Friends group<\/strong> and by the borough manager. They have received 6 resum\u00e9s, and the committee was in unanimous agreement that the <strong>citizens advisory committee<\/strong> should be appointed by the new council in 2012.<\/p>\n<p><a href=\"http:\/\/www.anthonydidonato.net\/wordpress\/wp-content\/uploads\/2011\/11\/Borough-Council-Legislative-Meeting-Votes-November-17th-2011-No-tax-hike-3rd-Street-Dam-Status-Media-PA-News_1321621013888.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1295\" title=\"Borough Council Legislative Meeting Votes, November 17th, 2011- No tax hike, 3rd Street Dam Status - Media, PA News_1321621013888\" src=\"http:\/\/www.anthonydidonato.net\/wordpress\/wp-content\/uploads\/2011\/11\/Borough-Council-Legislative-Meeting-Votes-November-17th-2011-No-tax-hike-3rd-Street-Dam-Status-Media-PA-News_1321621013888.png\" alt=\"\" width=\"235\" height=\"213\" \/><\/a><\/p>\n<h2>Preliminary Budget Approved<\/h2>\n<p><strong>Peter Williamson<\/strong> presented the preliminary budget, and indicated that it does not have to be in balance, and that Borough Council must present a preliminary budget in November. The final budget, approved in December, must be in balance. He indicated that the preliminary budget was in balance.<\/p>\n<p>Based on a direct question <strong>from Sue Serbin<\/strong>, reporter for <strong>Media Town Talk<\/strong>, he indicated that <strong>there would be no tax increases in 2012<\/strong>.<\/p>\n<p>The highlights:<\/p>\n<ul>\n<li>$7.4M operating budget, slightly higher than 2011, due to increases in gasoline costs, and salary increases.<\/li>\n<\/ul>\n<p>He indicated that there were increases to groups the Borough makes contributions to, such as:<strong><\/strong><\/p>\n<ul>\n<li><strong>Library<\/strong>, <strong>Fair Trade Commission<\/strong>, <strong>Media Arts Council<\/strong>.<\/li>\n<li>He added that there was a new line item for the <strong>Economic Development Committee<\/strong><\/li>\n<\/ul>\n<p>Capital budget is significant this year due to repairs needed in town infrastructure:<\/p>\n<ul>\n<li>Repairs needed for Parking Garage: <strong>$125K into Parking Garage.<\/strong><\/li>\n<li>North Olive Street: due to storms, storm sewers in that part of town have failed. Our engineer has designed a significant replacement which will last a lifetime.<\/li>\n<li>Regular ongoing expenses for <strong>3rd Street Dam<\/strong>, while reimbursed by the state, need to be in the budget<\/li>\n<\/ul>\n<p><strong>Pete Alyanakian<\/strong> noted that this was the first balanced budget he had heard of in November, and highlighted the significant capital requirements next year. The preliminary budget was approved unanimously.<\/p>\n<h2>Celebrate Media<\/h2>\n<p>Councilwoman <strong>Dawn Roe<\/strong> spoke briefly regarding the <strong>Celebrate Media<\/strong> event in the\u00a0 past week went well. She stated that the event on Thursday went well and had a bigger turnout than expected. The Friday event with <strong>Blackthorn<\/strong> was also a great success, she said. She said that the committee would like to stay together and promote themselves, and to improve communication throughout the borough and within the non-profit groups.<\/p>\n<p>She also wanted to thank the borough <a title=\"Borough Council Special Meeting Votes, August 4th, 2011: $7,000 approved in 4-3 vote\" href=\"http:\/\/mediapanews.com\/2011\/08\/09\/borough-council-special-meeting-votes-august-4th-2011-7000-approved-in-4-3-vote\/\">for the donation to the event<\/a>.<\/p>\n<p>She noted that the revenue numbers for the event were not available yet, but would be reported in the working meeting next month.<\/p>\n<p><strong>Pete Alyanakian<\/strong> commented, \u201cAttendance was not what we hoped for,\u201d but congratulated the non-profits for working together.<\/p>\n<p><strong>Ms. Roe<\/strong> said that they had 100% participation from the non-profit groups, and <strong>Mr. Alyanakian<\/strong> added that the events showcased the theater in a positive way. <strong>Eric Stein<\/strong> added as clarification that <strong>Media Borough<\/strong> donates funds to all of non-profits involved in the event in the annual budget.<\/p>\n<h2>Other Items of interest<\/h2>\n<p>Some items of interest for residents:<\/p>\n<ul>\n<li><strong>The CMAQ Project<\/strong> can be seen along Baltimore Avenue with new lights, and new curbs for wheelchairs at almost every intersection. A question was asked about an updated timeline for the project, and Borough Engineer <strong>Bob Johnston<\/strong> stated he would get an update. <strong>Dr. Eric Stein<\/strong> requested an updated status report to avoid having issues during the holidays. <strong>Mr. Alyanakian<\/strong> referenced the 5 points traffic lights and changes to be made to avoid having downward-pointing lights, and possible improvements to confusing signage.<\/li>\n<li><strong>Sewer System Smoke Testing in the Southeastern parts of Media: <\/strong>During storms, <strong>Little Washington Waste Water<\/strong> (LWW) has noted that <strong>sewage flow increases dramatically<\/strong>, indicating an <strong>issue with the sewage systems and the storm water management systems<\/strong>. Media Borough in cooperation with LWW will be testing the systems by literally blowing smoke through the sewage system to find where leaks are occurring. Residents <strong>south of Baltimore Pike<\/strong> and <strong>East of Monroe street<\/strong> should be aware of the testing in coming weeks, \u201cin case they see smoke coming from their toilets\u201d said <strong>Peter Williamson<\/strong>.<\/li>\n<li>A new <strong>Parking Meter Debit Card Program<\/strong> will be introduced over the holidays, with $300 worth of cards issued to the MBA by Media Borough. Kevin Schramm, chair of the Media Business Authority, was asked to speak and said the program is worthwhile to help raise awareness of the card program, and to bring people back to Media. <strong>Councilwoman Monica Simpson<\/strong> asked how members of the public would reload the card. Borough Manager Jeffrey Smith indicated that the card could only be reloaded at the borough offices.<\/li>\n<li>Media Borough is seeking to fill a vacancy on the <a href=\"http:\/\/www.mediaborough.com\/boardsandcommissions\/environmental-advisory-council-eac\"><strong>Environmental Advisory Council<\/strong><\/a><\/li>\n<li>Media\u2019s <a href=\"http:\/\/www.statestreetblues.com\/\">Jazz By Night <\/a>celebration was named as one of the Top 8 Events by the <strong>PA Festival Association<\/strong><\/li>\n<li><a href=\"http:\/\/mediauplibrary.org\/\">Media\/Upper Providence Library<\/a> is needing repairs and is raising funds. Employees from <strong>Vanguard<\/strong>\u00a0 cleaned up the library on Veterans Day, <strong>Spietzle architecture group<\/strong> working with the Library to raise money for library, and the MBA gave a check for $500 to the library for ongoing efforts<\/li>\n<li>There will be <strong>Public Hearing<\/strong> next month before the legislative meeting for borough land subdivisions: Chairman of <strong>Planning Commission<\/strong> <strong>Kevin Matson<\/strong> has been working with <strong>Planning Commission<\/strong> and some <strong>Community Design Committee<\/strong> members to re-do land subdivision ordinance and land development ordinances.<\/li>\n<li><strong>Monica Simpson<\/strong> requested feedback on the <a href=\"http:\/\/www.mediaborough.com\/?utm_source=mediapanews\">new borough website<\/a>, and added that anyone wishing to be notified in emergencies register their phone number and address on the\u00a0 website to be added to the emergency contact list.<\/li>\n<\/ul>\n<h2>Public Comments<\/h2>\n<p>At the start of the meeting, after <strong>unanimously approving<\/strong> the meeting minutes from the Workshop Meeting on <strong>October 6th<\/strong>, the Special Meeting Minutes (<a title=\"3rd Street Dam Public Meeting October 13th, 7:00 PM, Part 1: Petition, Peer Review, and Greenway\" href=\"http:\/\/mediapanews.com\/2011\/10\/17\/3rd-street-dam-public-meeting-october-13th-700-pm-part-1-petition-peer-review-and-greenway\/\">regarding the 3rd Street Dam<\/a>) on <strong>October 13th<\/strong>, and the Council Meeting minutes from October 20th, comments were taken from the public.<\/p>\n<p><strong>Luic Barnieu<\/strong>, a representative from the <a href=\"http:\/\/mediabusinessauthority.com\/boardofdirectors\/index.html\">Media Business Authority<\/a>, presented a check on behalf of <strong>Dining Under the Stars <\/strong>to donate turkeys to members of the community in need, in conjunction with the <strong>Media Police.<\/strong><\/p>\n<p><a title=\"Media, PA Sample Ballot for Election Day Tuesday, November 8th\" href=\"http:\/\/boroughcouncil2011.com\/paul-robinson\/\"><strong>Paul Robinson<\/strong><\/a>, a resident and councilman-elect, congratulated borough employees, <strong>Jim Jeffery<\/strong>, <strong>Larry Bok<\/strong>, the highway crew, and <strong>Emergency Services Management<\/strong> crew for their handling of the <strong>Veterans<\/strong> <strong>Day Parade<\/strong>. He also extended congratulations to the <strong>Media Police Department<\/strong>, as well as the\u00a0 veterans in the parade. Borough Council President <strong>Pete Alyanakian<\/strong> also congratulated <strong>Bob Dimond<\/strong> and Mayor Bob McMahon, and the attending crowd gave a round of applause.<\/p>\n<p><strong>Paul Indorf<\/strong>, a resident from 4th Street, also congratulated the borough on the Veterans Day parade. Then, referencing the <a href=\"http:\/\/www.mediaborough.com\/council\/special-meeting-third-street-bridgedam-design\">October 13th Special Meeting for the 3rd Street Dam<\/a> meeting minutes, Mr. Indorf had concerns regarding the audio recording of the meeting. <strong>Councilman Dr. Eric Stein<\/strong> interjected that a DVD of public meetings is available in the library, however, Borough Manager <strong>Jeffrey Smith<\/strong> mentioned that this meeting was not videotaped, and the official audio record had \u201ctechnical difficulties.\u201d<\/p>\n<p><strong>Mr. Indorf<\/strong> went on to discuss a letter he distributed prior to the election. He continued to discuss a meeting held between the 3rd Street Dam committee and PennDOT. <strong>He asked if Mr. Alyanakian had lied to him regarding the time of the meeting<\/strong>. <strong>Mr. Indorf<\/strong> had asked at the workshop meeting if there was \u201ca meeting with the engineers,\u201d and Mr. Alyanakian responded in the negative. He then asked if Mr. Alyanakian had lied to him regarding the meeting, to which Mr. Alyanakian responded, \u201cNo.\u201d<\/p>\n<p><strong>Mr. Indorf<\/strong> went on to request that Mr. Alyanakian recuse himself from any and all <strong>3rd Street Dam<\/strong> matters, due to a conflict of interest of Mr. Alyanakian and the 3rd Street Dam project.<\/p>\n<p>Councilman <strong>Peter Williamson<\/strong> interjected that typically members should recuse themselves from voting on matters when there is a financial interest at stake. <strong>Mr. Indorf<\/strong> continued and said he had read Section 12 of the Borough Code, and referenced <strong>Mr. Alyanakian\u2019s<\/strong> known association with the County and his association with the swim club. Mayor <strong>Bob McMahon<\/strong> interjected and indicated that <strong>Mr. Alyanakian<\/strong>\u2018s associations are well known among council, and asked for some specific evidence from <strong>Mr. Indorf,<\/strong> and asked him to move on. After some further discussion, <strong>Mr. Indorf<\/strong> ended his statements.<\/p>\n<p><strong>Bob Dimond<\/strong>, tax collector for Media Borough, wanted to personally thank everyone who worked on the parade, and knowing his wife was watching, he referenced a quote from the speech where <a href=\"http:\/\/www.whitehouse.gov\/administration\/vice-president-biden\"><strong>Vice President Joe Biden<\/strong><\/a> said that he and <strong>Bob Dimand<\/strong> had one thing in common: <strong>They were both in love with his wife, Dale<\/strong>. <strong>Mr. Dimond<\/strong> then made a humorous reference that he was speaking up so she wouldn\u2019t be on her way to Washington.<\/p>\n<p><strong>Letitia Jeavons<\/strong>, a resident of Media, asked if anyone from the <strong>PA Department of Environmental Protection<\/strong> had weighed in on\u00a0<strong>Dam Safety<\/strong> committee and on the ownership issue with the <strong>3rd Street Dam.<\/strong> <strong>Mr. Alyanakian<\/strong> referenced the stipulation and said that the borough would not have been able to move forward without settlement of the ownership issue and that he felt that the state felt settled in that matter.<\/p>\n<p><strong>Mr. Alyanakian<\/strong> congratulated the Councilmen-elect in the room, <a title=\"Vice President Joe Biden to attend Veterans Day Parade November 11th, 2011\" href=\"http:\/\/boroughcouncil2011.com\/kent-davidson\/\"><strong>Kent Davidson<\/strong><\/a>, <strong><a title=\"Media, PA Sample Ballot for Election Day Tuesday, November 8th\" href=\"http:\/\/boroughcouncil2011.com\/brian-hall\/\">Brian Hall<\/a><\/strong>, and <a title=\"Election jabs heat up in Media Borough Council race\" href=\"http:\/\/boroughcouncil2011.com\/paul-robinson\/\"><strong>Paul Robinson<\/strong><\/a>, and wished them luck in the coming term.<\/p>\n<h2>Other Votes Approved<\/h2>\n<ul>\n<li>The liquor license for <strong>Spasso\u2019s Inc<\/strong>. (at <a href=\"http:\/\/mediapanews.com\/tag\/1-west-state-street\/\">1 West State Street<\/a>) was updated to reflect the accurate comany name. The License Number is R-4813.<\/li>\n<li>Updates to traffic codes to reflect changes made in the past year (for example, the stop sign at <strong>3rd and Lemon Street<\/strong>)<\/li>\n<li>Approved the mass gathering permit for <strong>Veterans Day Parade<\/strong> after the fact<\/li>\n<li>Authorize amendments to the residential parking ordinance (to reflect changes in residential parking changes, added and removed spaces, etc.)<\/li>\n<li><strong>Dean Sherwin<\/strong> resigned from the <a href=\"http:\/\/www.mediaborough.com\/boardsandcommissions\/environmental-advisory-council-eac\"><strong>Environmental Advisory Council<\/strong><\/a> due to moving out of town.<\/li>\n<li>Payment of bill for $650,216.67 from the <strong>General Fund<\/strong>, $460.22 from the <strong>Recreation Fund<\/strong>, and $18,118.29 from the <strong>Capital Fund<\/strong>.<\/li>\n<li>Approved repair work on <strong>Leaf Collection Machine:<\/strong> Accept low bid for $7700.16.<\/li>\n<li>Accept Resignation\/Retirement of <strong>Sandra Bennett<\/strong> from <strong>Police Department<\/strong>. She was a <strong>Parking Enforcement Officer<\/strong>, and <strong>Information Services<\/strong> officer within the department.<\/li>\n<\/ul>\n<h2>Final Comments<\/h2>\n<p>The meeting ended with public comments from <strong>Bob Dimond<\/strong>, the tax collector for Media, who thanked <strong>Sue Serbin<\/strong> for publicity for coverage of Veterans parade, and <strong>Courtney Elko<\/strong> for <a href=\"http:\/\/media.patch.com\/articles\/vice-president-joe-biden-visits-media-for-the-52nd-annual-veterans-day-parade#photo-8418938\">videos and coverage of the Veterans Day parade<\/a>.<\/p>\n<p><strong>Addie Cianella<\/strong> gave thanks to <strong>Monica Simpson<\/strong> for her work with the <strong><a href=\"http:\/\/mediafarmersmarket.com\/\">Media Farmers Market<\/a><\/strong> and looked forward to the third year for the market.<\/p>\n<p><strong>Paul Indorf<\/strong> was the final speaker during the public comment and privilege of the floor and made a suggestion regarding the Parking Card and linking it directly to one\u2019s bank account. He then\u00a0 went on to talk about the Vice President\u2019s comments at the Veteran\u2019s Day Parade regarding the Vow to Hire Hero\u2019s Act, and suggested that the house go through and approve it, and that Pat Meehan put forward the law in the house. He encouraged everyone to talk to Rep. Meehan to support that Act. He then went on to discuss recent meetings and talked at length, saying, \u201cA lot of [us] \u2026 felt bruised and battled in this process, I think it\u2019s a matter of looking at all possible options are and with regard to the dam \u2026\u201d and went on to introduce the concept of breaching the <strong>3rd Street Dam.<\/strong><\/p>\n<p>After Mr. Indorf spoke for approximately 8 minutes, <strong>Bob McMahon<\/strong> requested Mr. Indorf not take as much time as he has said that in his years on council he has never heard anyone accuse a member of council of lying, and requested that he make his points in a more succinct manner in the future.<\/p>\n<p>The meeting was adjourned after 1 hour and 27 minutes.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Borough Council met on Thursday, November 17th, 2011 at 7:30 PM.
