Builders broke ground on more homes last month as housing starts jumped 2.6 percent nationwide in April over March, the Commerce Department reported this week.

The single-family sector saw a 3 percent increase in housing starts in April, while multifamily construction projects saw a 3.2 percent rise.

“April’s increase in housing production comes on top of strong upward revisions to the previous month’s data, and is an encouraging sign that we are returning to a gradual, upward trend that should continue in the year ahead as builders respond to improving demand for new homes in certain markets,” Barry Rutenberg, chairman of the National Association of Home Builders, said in a statement. “Unfortunately, overly restrictive lending conditions for builders and buyers are slowing the pace of this trend considerably.”

Regionally, housing starts were mixed. The Midwest and South saw some of the biggest gains in housing starts in April, with the South surging 11.6 percent and 6.7 percent in the Midwest. Meanwhile, the Northeast saw housing starts in April drop 20.7 percent, and by 8.1 percent in the West.

While the new-home sector has seen recent gains, the rate of production is still half of what is considered healthy for a normal market.

Housing permits — a future gauge of home building — dropped 7 percent in April, mostly attributed to a slide in multifamily permits, which dropped 20.8 percent last month. Meanwhile, single-family permits increased 1.9 percent in April. Last month, building permits posted a three-and-a-half-year high mostly from a surge in permits for apartment construction.

Foreclosures Plummet to 5-Year Lows

For the third consecutive month, foreclosure filings dropped, sinking to their lowest level since July 2007, according to RealtyTrac’s April report on nationwide foreclosure activity.

Foreclosure activity, which includes default notices, scheduled auctions, and bank repossessions, fell 5 percent from March to April and were down 14 percent year-over-year.

“More distressed loans are being diverted into short sales rather than becoming completed foreclosures,” says Brandon Moore, CEO of RealtyTrac.

The drop in foreclosure activity was mixed, however.

“Rising foreclosure activity in many state and local markets in April was masked at the national level by sizable decreases in hard-hit foreclosure states like California, Arizona, and Nevada,” Moore said in a statement.

For example, in Nevada and Arizona, bank repossessions dropped about 70 percent and by more than 50 percent in California.

Meanwhile, in states like Florida, New Jersey, and Illinois, which require judicial review, foreclosure activity increased. New Jersey had the largest annual increase in foreclosure starts in April seeing a 180 percent jump.

In the 26 states that have a judicial foreclosure process, foreclosure activity was up 15 percent compared to April 2011.

Builders Get More Confident About Improving Market

“Firming home values, improving employment, and low mortgage rates” are driving greater optimism over a recovery taking shape in the new-home market, says David Crowe, chief economist for the National Association of Home Builders.

Builder confidence for the market of newly built single-family homes rose five points this month, posting its best reading since May of 2007, according to a measure of builder sentiment by NAHB/Wells Fargo. The index measures builder sentiment on sales conditions and expectations as well as buyer traffic.

Builders in many markets are reporting that buyer traffic and sales have picked back up after a pause this April,” says Barry Rutenberg, NAHB chairman. “It seems we have resumed the gradual upward trend in confidence that started at the beginning of this year, as stabilizing prices and excellent affordability encourage more people to pursue a new-home purchase.”

Still, housing experts warn the new-home market still has a long way to go toward normalizing, based on historical trends. Builders say consumer access to credit, inaccurate appraisals, and the rise in materials costs for new construction continue to pose major challenges to the industry.

According to May’s index, the largest gains in builder confidence occurred in the Northeast, followed by Midwest and South. The West posted a two-point decline in builder sentiment for May, according to the index.

Home buyers and refinancers applying for a mortgage are being caught off guard in what all lenders are asking for when approving a loan.

The Wall Street Journal reports an incident where a borrower was even asked for a copy of her divorce decree — from two years ago — and asked to explain a deposit of about $200 into her bank account when applying for a mortgage.

Lenders are being more careful in who they issue a loan to nowadays, tightening underwriting standards and carefully documenting applicants’ finances and ability to repay the loan.

Practically nothing is off the table these days when it comes to what a lender may ask for. Lenders may question any deposits to bank accounts, increases in a borrower’s income, and any disputed balance over a late payment, even if it was from years ago. Some lenders are even requesting college transcripts and diplomas in verifying employment history.

Any credit inquiries on a person’s credit invites red flags and more questions from lenders, Rhonda Porter, a loan officer in Seattle, told The Wall Street Journal.

“I have customers who know they’re a strong [borrower], and they’re still asked for documentation,” Porter says. “Some of them get their feathers ruffled.”

Some borrowers — particularly refinancers — are getting so frustrated by the extra paperwork and questions that they are increasingly just stopping the process, according to news reports.

Stella Adams, a fair housing advocate in North Carolina, says banks need to lighten up. Banks should return to “solid, old-fashioned underwriting” standards that were used prior to the housing boom and stop making it so difficult for people to get financing.

Some housing deals are coming with sweet incentives for the real estate agents who can bring in a buyer, everything from big bonuses to fancy cars. But if you’re not careful, you might get in trouble for steering, some real estate professionals warn.

A home seller in Virginia is offering a C-Class Mercedes, priced at $37,900 — or $30,000 bonus, whichever is preferred — plus commission to a buyer’s agent who is able to bring a buyer to his $1.9 million home. Other incentives sellers are reportedly using to push a sale, include offers to buyer’s agents of fancy trips, higher commissions, or gifts.

“Bonuses and high commissions could motivate an agent to encourage a client to buy the house that offers the best reward to the agent, rather than the home that’s best for the client,” Bobbie Noreen, managing broker with Village Real Estate Services in Nashville, told Inman News. “That’s the problem with any incentive, whether it’s a fur coat, a trip, or a $2,000 bonus. Our code of ethics says we are not allowed to participate in self-dealing. To steer them (the client) is against the Code of Ethics. It’s borderline illegal.”

But some agents say the incentives don’t break any rules and can help sellers attract extra attention to their listings. Plus, if any agent is uncomfortable taking a pricey bonus for selling a home, they could always negotiate a lower sales price on behalf of their buyer for the amount being offered instead, says Frances Flynn Thorsen, a real estate educator and consultant in Tucson, Ariz.

“If a property is priced right, it’s going to sell,” says Doreen Roberts, president of the Bay East Association of REALTORS® in Northern California. “I know sometimes sellers do offer higher bonuses to entice agents to show the property. MONEY magazine) — Laurie Goodman is an apolitical number cruncher who has spent most of her 28-year career out of the public view, studying the minutiae of mortgage-backed securities (MBS) for big investment banks. She’s long been a star among Wall Street insiders, however. She holds the record for the most top rankings for fixed-in-come research from the trade bible Institutional Investor.

While Goodman concedes she underestimated the impact of the housing bubble’s bursting early on, by mid-2007 she was warning investors to prepare for a deep downturn. She prepared herself as well.

After her employer at the time, UBS, shut down its mortgage trading desk in 2008, she jumped to Amherst Securities, a small company that serves as an MBS broker-dealer for big investors. From there she’s published research that has raised her profile and made her an oft-cited source by would-be housing reformers in both the private and public sectors. If she is underestimating the problems the housing market has now, we’re all in trouble.

Goodman often pauses several seconds before speaking, choosing her words deliberately. So it is especially distressing to hear her warn of a potential housing “death spiral.”

On top of the 2.5 million homes that have already fallen to foreclosure since the bubble burst, another 4.5 million mortgage holders have given up paying and are likely to lose their homes, she calculates.

‘Shareholders of the world unite’

Millions more are underwater — owing more than their home is worth — and may give up if things don’t improve soon. All told, Goodman warns that more than 10 million of the nation’s 55 million mortgage holders could default by 2018. If home prices fall much more than the 6% or so she’s projecting over the next 12 to 18 months, the picture worsens, as more foreclosures drive prices down further, in turn causing more sheriffs’ sales.

Goodman’s research into who defaults shows that many governmental and private efforts at saving borrowers — and reducing investors’ losses — by modifying mortgages weren’t helping because they only extended payments or reduced interest rates. They didn’t fix the fundamental problem of unsupportable debt loads.

Bailout concerns mounting for federal housing agency

Goodman found that investors lose as much as 70% when the homes underlying their subprime MBS are foreclosed upon. Lenders that tried to rehabilitate delinquent borrowers by reducing the principal (or total amount owed) by an average of 26% were far less likely to have to foreclose, and they actually provided MBS investors higher returns. “If you save a borrower, you save an investor,” Goodman says.

To avoid the “moral hazard” of rewarding foolish borrowers, Goodman recommends that lenders swap immediate principal reductions for shares of any gains on the mortgaged house when it is sold.

Many mortgage holders, including giants Fannie Mae and Freddie Mac, are refusing any kind of principal-reduction deals, however. Some don’t want to have to take the immediate write-downs that would be required, preferring to delay the financial pain and hope for a rebound.

‘One bailout = endless bailouts’

Many servicers refuse to consider them because their fees are tied to the amount of principal rather than to the ultimate payback to investors. And banks often hold second mortgages for the loans that they service. Principal reductions typically require them to take total losses on those notes.

In short, banks “are ridden with conflicts of interest” that pit them against the interests of borrowers and investors, Goodman says. “Many of the rules in place now are extremely large-bank-friendly, but borrower- and investor-unfriendly.”

Goodman’s firm, of course, is decidedly on the side of the MBS investor in this fight. Nevertheless, ideas she’s been advocating since 2008 are catching on.

The Treasury Department and several state attorneys general are encouraging lenders to offer principal-reduction options. And “shared appreciation mortgage” (SAM) modifications have won support from big thinkers such as Nouriel Roubini, the New York University economist who warned of a housing bubble in 2005. Roubini, who cites Goodman’s work in his own, recently co-wrote a report suggesting that SAMS could help “unclog the real estate and financial arteries and restore healthy circulation.”

At least one private servicer, Atlanta-based Ocwen Financial Corp., has started to try this “share the pain and gain” option. “Progress is slow,” Goodman says, “but I feel like I am getting some traction.”

For taxable accounts, Goodman likes municipal bonds. In an IRA, she says, mortgage securities backed by Fannie or Freddie (now propped up by taxpayers) are more attractive than corporate bonds.
