The agreement, focused on various multiple listing service policies, was approved by the Justice Department in November 2020. In a news release issued today, NAR called the department\u2019s attempt to withdraw from the agreement\u2014after NAR had already begun to implement its terms\u2014\u201ca breach of the agreement and the law.\u201d<\/p>\n\n\n\n<p>NAR\u2019s guidance for MLSs has long been recognized by courts as fostering fair and competitive real estate markets for home buyers and sellers. Having buyer brokers\u2019 compensation come from the listing broker\u2019s commission \u201cincreases competition by allowing small brokerages to compete on a level playing field with large brokerages and promotes equitable homeownership opportunities for all consumers,\u201d the association said in today\u2019s release.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.nar.realtor\/newsroom\/national-association-of-realtors-files-petition-to-oppose-department-of-justice-breach-of-settlement-agreement\">Read the full news release.<\/a><\/p>\n\n\n\n<p>NAR President Charlie Oppler, a CEO of Prominent Properties Sotheby\u2019s International Realty, Franklin Lakes, N.J., said, \u201cThe DOJ action should be considered null and invalid based on legal precedent alone.
